Your employer can fire you for being late to work, even if you are late just that one time.
This is a termination without cause. In Canada, companies can let non-unionized employees go for any reason, as long as you are provided full severance pay and the reasons for your dismissal are not discriminatory.
What your employer can’t do in this situation is fire you for just cause. Just cause would mean no EI Benefits or severance pay.
Just cause dismissals are for serious offences such as: such as theft or insubordination.
Can my employer discipline me for being late?
You could face discipline if it impacts the work in an adverse manner.
However, if you are late one time, it would be unreasonable for the company to discipline you.
What happens if the TTC stops working and you will now be 15 minutes late?
Yes, your employer could issue a verbal or written warning. But, you don’t have to accept any major changes to your job.
Employers tend to use these situations to issue demotions, cut in pay, reduction in hours, or try to change your commission. This is illegal.
If the terms of your employment have been significantly altered, the law allows you to resign from your job and seek full severance. This is referred to as a constructive dismissal!
